Welcome to website https://www.cabfoods.co.za/, of which CAB Foods (PTY) Ltd (“CAB Foods”) has full ownership and operational control. The website allows you to utilise the online store and shop from an extensive range of cooking and baking products, party supplies and packaging. We have compiled the website’s “Terms and Conditions” to regulate the way products are ordered, sold, delivered as well as the usability of the website. The purpose of which is to:

• Reduce the risk and liability of CAB Foods;
• Establish the risk or liability for the user of the website;
• Persuade the user to indemnify CAB Foods;
• Advise user to recognise and accept a fact.

It is necessary for all persons who have access or makes use of this website including all those users who register as anticipated below to recognise, understand and comply with these Terms and Conditions. If there is any condition stipulated in the Terms and Conditions that you do not understand, you are obliged to ask CAB Foods to provide an explanation before you accept the Terms and Conditions or continue using the website. Please note that by registering as a user on the website you hereby recognise that you have read and accepted these stipulated Terms and Conditions.

Registration and Usability of the Website:

We allow both registered and unregistered to users can order products on the website.

To register as a user, you are required to create a unique username and password and impart personal information to CAB Foods, such as contact details and address. It is necessary to use your unique username and password to gain access to the website and to purchase products from the online store.

You are required to agree and guarantee that your username and password shall:

Be employed for personal use only; and

Not be divulged by you to another third party.

You must enter the correct username and password every time you order goods to ensure access. This is also necessary for security purposes.

Once you have entered the correct username and password allowing access to your account, even if unauthorised or fraudulent, you recognise that you are responsible for the payment of such order, with the expectation where you have cancelled the transaction in accordance with these Terms and Conditions.

You must concede to promptly notify CAB Foods as soon as you are aware and suspect any unauthorised infringement or use of your unique username or password and to take measures to alleviate any subsequent loss or harm.

By using the website, you guarantee that you are 18 years old or older and of sound legal capacity. Users under the age of 18 do not have legal authorisation to enter into a binding agreement and you are required to use the website under the supervision of your parent or legal guardian. Once your parent or legal guardian has provided his or her consent, then said person acknowledges that he or she is bound to these Terms and Conditions and is takes on your liability, responsibility and obligation under these Terms and Conditions.

You agree that you will not under any circumstances employ a device, software or any other instrument that can interfere or attempt to interfere with the functioning of the website. In conjunction with this, you agree that you will in no way utilise a robot or any other automatic device or manual process to monitor, duplicate, dispense or alter the website and the information displayed therein, unless written consent has been provided from an authorised CAB Foods representative.

It is in no way permitted for your exhibit, publish, post, print, duplicate or use in any way the website and information enclosed therein, unless a valid written consent has been granted by an authorised CAB Foods representative.

Transaction of Sale and Availability of Stock:

CAB Foods has the power to accept or reject the orders for products placed by registered users. This depends on whether products are available, the information related to the product is correct (including, not exclusively the price) and the receipt of payment or authorisation of payment by CAB Foods for the product.

PLEASE NOTE: CAB Foods will only signify the acceptance of your order once the product has been delivered to you, or ready for collection, and only in this event will an agreement of sale between you and CAB Foods take place (the “Sale”). This is the case, irrespective of whether a communication from CAB Foods stipulated that your order or payment thereof has been confirmed. CAB Foods will identify the rejection of your order by cancelling it and will subsequently refund you for the amount already paid.

Your order may be cancelled at any time proceeding delivery or collection, if you do so before receiving a dispatch or delivery notice.

You must be mindful that the stock of all products is limited, and the pricing thereof may change at any time without announcement. With regards to products offered for sale by CAB Foods, CAB Foods will do everything in their power to track stock levels and take necessary measures to stipulate on the website when the stock is no longer available, and the offers thereof are discontinued. It is, however, important to note that CAB Foods cannot always guarantee the availability of stock. In the event where products are no longer available after the order has been placed, CAB Foods will promptly notify you and provide assurance that you are entitled to a refund of the exact amount already paid by you for said product.

It must be emphasised that certain products are not permitted to be purchased for resale. In the event where we suspect these said products are purchased for resale, we have the authority to cancel your order straight away and we will provide you with a notification thereof.

Payment Options:

Efforts have been made to ensure that secure online payments facilities are available. We guarantee that all transactions are encrypted with the applicable encryption technology.

All products sold by CAB Foods should be purchased via:

• Debit card (with Visa, MasterCard logo and CVV number and expiry date);
• Credit card (VISA, Mastercard etc.): In the event where payment is made via credit card, we may require additional information to enable verification and validation of the payment. In such instances, we have the authority to withhold delivery until we have received the necessary information and obtained authorisation for the required amounts. If such authorisation is not received by us, your order for the products will be cancelled. You are required to guarantee that you are fully authorised to utilise the credit card provided to pay for the products. In addition, you must affirm that your credit card has sufficient funds available to cover all the costs related to the services used on the website;
• Secure Instant Deposit EFT.

CAB Foods will under not be able to accept your order if the necessary payment has not been made.

Delivery:

CAB Food has multiple methods of delivery on offer. You may select the option of:

• Courier
• Postal service
• Uber
• Delivery to your door
• Users also have the option of Self-collection from one of CAB Foods stores.

With regards to delivery, customers can be referred to FAQ’s, should they require more information thereof and to receive the most up-to-date information regarding such. It is also important to note that fluctuations may occur in the delivery charges without warning to the user and maybe stipulate that the applicable delivery charges will be visible in your cart when you proceed to checkout.

Once you have received confirmation that your order is accepted, CAB Foods will begin the necessary procedure to deliver your products as soon as operably possible, with the assurance that it will be no later than 30 days after your receipt of payment (“Delivery period”). We warrant that we will notify you in the event where delivery of the products during the delivery period cannot take place. You are subsequently permitted to decide whether you would like to cancel your order of the products, within seven days of receiving such notification. If you choose to cancel your order under these stipulated circumstances, you will be reimbursed the full amount paid by you.

It must be emphasised that users must ensure they have enclosed the correct physical address.

CAB Foods shall not be responsible for any loss, damage or unlawful use of a product after a product has been delivered to your designated physical address.

Errors:

We shall do our utmost best to ensure that information regarding the description, availability, purchase price and delivery charges of products are accurately displayed on the website. However, it is important to note that should there be any errors of any kind on the website (which are not related to gross negligence on our part), we shall not be held accountable for any loss, claim or expense incurred as a consequence of a transaction based on an error, with the exception that the purchase price was incorrect – to the extent that we are obliged to refund you for any amount already paid, as outlined in the Returns Policy.
